GDPR Procurement Policy Notice – PPN 03/17- STOP PRESS

New data protection legislation is due to come into force during 2018, which aims to protect the privacy of all EU citizens and prevent data breaches. It will apply to any public or private organisation processing personal data.

We wish to bring to your immediate attention the procurement policy note (PPN 03/17) which gives details of draft clauses required for GDPR, details of which can be found at

The Crown Commercial Service (CCS) will require these clauses to be included in all framework agreements and call-off contracts (where processing personal data) before the implementation date of 25th May 2018.

The clauses shown in the PPN are draft and may change but give a good indication of what will be required. The G-Cloud Commercial Agreement team will be contacting suppliers early this year (2018) to undertake a contract variation to include these clauses in framework agreements. CCS will also be advising customer organisations to liaise with yourselves to arrange similar inclusions in current call-off contracts.

Please see a list of FAQs relating to the GDPR PPN in the document section

What can this agreement offer?

G Cloud 9 is a Framework Agreement of 12 months’ duration, however the duration may be extended for any period up to a maximum of twelve months from the expiry of the initial term.

The Framework Agreement is for use by UK Public Sector bodies which allows them to choose and purchase cloud computing services covering infrastructure, platform, software and specialist cloud services. The framework is for commodity based, pay-as-you go cloud services across three lots:

Lot 1: Cloud Hosting (IaaS) and (PaaS)

These must be cloud platform or infrastructure services that can help buyers do at least 1 of: deploy, manage and run software and provision and use processing, storage or networking resources

Lot 2: Cloud Software (SaaS)

These must be applications that are typically accessed over a public or private network e.g. the internet and hosted in the cloud

Lot 3: Cloud Support

These must help buyers set up and maintain their cloud software or hosting services

Any Call Off Contract placed will have a maximum initial duration of 24 months, with two extensions allowed, each of up to 12 months. Certain restrictions apply to central government contract extensions.

Replacements: Cash Releasing Savings

When customers are replacing  ‘in-house’ software, infrastructure and platforms with cloud based services, the whole cost of running these currently will be compared on a customer by customer basis against the new total costs. Savings will be shown by the reduction in licenses, support staff, equipment running and maintenance costs and capital outlay for infrastructure.

Demand Management Savings

In situations where the Cloud services being purchased are new (i.e the customer has not replaced an existing service provision with a cloud service) there is still an opportunity to claim demand management savings.

The G-Cloud 9 framework agreement is the latest iteration of the framework which allows UK public sector bodies (central government departments, arm’s length bodies, non-departmental public bodies, NHS bodies and local authorities) access to Cloud Computing Services via a compliant procurement vehicle.

G-Cloud services, available via the Digital Marketplace, require frequent procurement refreshes to bring on new suppliers and services. New iterations of this framework are being considered at a varying frequency of 6-12 months, depending on the demand for and/or availability of new services as the IT Cloud market develops.
